Lawyer William Kusi, counsel for Akosua Serwaa, widow of the late highlife legend Daddy Lumba, has sharply criticised the judicial process that allowed the musician’s funeral to proceed, describing the ruling as legally flawed and unprecedented.

Speaking on Angel FM in Kumasi after the return of his client to Ghana, Lawyer Kusi explained that Akosua Serwaa’s absence from the funeral was not out of disregard but was dictated by ongoing legal proceedings surrounding the burial.

According to him, a day before the funeral, an application was filed in court seeking a restraining order to halt the funeral pending investigations, including a police probe into the cause of Daddy Lumba’s death.

Based on the evidence before the court, her legal team was confident the restraining order would be granted.

However, events took an unexpected turn when the court declined the application. Lawyer Kusi further alleged that the judge later recalled the case on the same day and altered the ruling, a development he described as shocking and deeply troubling.

“I was surprised. The judge called back the case the same day and changed the ruling. That day remains one of the darkest I have witnessed in a court of law,” he stated.

He criticised the legal procedure adopted by opposing counsel, insisting it was wrong and contrary to established legal practice. Nonetheless, he said the case has now become an important legal reference.

“I am actually glad this happened. It is now on record, and law students will study this case in school,” he noted.

Lawyer Kusi stressed that the law must be applied strictly, without sentiment, explaining that their opposition to the ruling is based purely on legal principles.

“There is no common sense in law. The law is the law, and it must be applied as it is,” he added.
