JUSTICE KULENDI, BUSINESSMAN DRAGGED TO CID OVER ALLEGED INTERFERENCE IN ATO FORSON CASE

A Ghanaian citizen, Mr. Daniel Marfo Ofori-Atta, has filed a petition with the Criminal Investigations Department (CID) of the Ghana Police Service, asking them to investigate Supreme Court Judge, Justice Yonny Kulendi, and businessman, Mr. Richard Jakpa. He claims the two tried to interfere with the ongoing trial of former Deputy Finance Minister, Dr. Cassiel Ato Forson, and others.

Mr. Ofori-Atta said he submitted the petition out of his commitment to protect the rule of law, good governance, and Ghana’s democracy.

In his petition, he asked the CID to look into the actions of Justice Kulendi and Mr. Jakpa to “uncover all possible criminal acts and take the necessary steps in line with the law.”

The petition alleges that Mr. Jakpa, who is standing trial alongside Dr. Forson, tried to use his family ties with Justice Kulendi to influence the case in his favor. The ultimate goal, according to the petition, was to either get him acquitted or have the charges dropped by the then Attorney-General, Mr. Godfred Yeboah Dame.

It further claims that their conduct could amount to criminal interference in legal proceedings under Ghana’s Criminal Offences Act, 1960 (Act 29).

Main Allegations in the Petition

Influence at Arraignment (January 18, 2023): After his arraignment, Mr. Jakpa allegedly sought Justice Kulendi’s help to convince the Attorney-General to free him even though he had not met his bail conditions. Justice Kulendi reportedly visited the Attorney-General’s office to make this request.
Facilitating Contact: Justice Kulendi allegedly gave Mr. Jakpa the Attorney-General’s phone number. Jakpa then sent several WhatsApp messages asking to meet. Court records show that these messages, which later became evidence in June 2024, were mostly unanswered. The Attorney-General only replied twice.
WhatsApp Messages: In total, Jakpa reportedly sent 68 WhatsApp messages, while the Attorney-General replied only two times. This was confirmed in court during cross-examination by the Director of Public Prosecutions, Mrs. Yvonne Atakora-Obuobisa.
Private Meetings: After the Attorney-General refused to meet Jakpa, Justice Kulendi allegedly invited Jakpa to his home on at least four occasions. These secret meetings, the petition claims, were meant to interfere with the trial by attempting to stop the prosecution or secure Jakpa’s release during the no-case submission stage.

The petition is said to include WhatsApp chats between Jakpa and the Attorney-General, as well as court records that point to possible interference.

Mr. Ofori-Atta also revealed that he plans to petition the President to remove Justice Kulendi from office for misconduct.
